2. Description of Service

EggieAI is an AI-powered platform that enables users to create, edit, save, and share visual stories, comics, manga, webtoons, and storybooks. The Service uses artificial intelligence technology to generate images and assist in content creation based on user inputs.

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

4. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You may register using third-party authentication services (Google, Apple, Facebook). You are responsible for maintaining the security of those accounts.

5. User Content

"User Content" means any prompts, text, images, comics, comments, uploads, or other materials you create, submit, or publish on EggieAI.

5.1 Copyright

You retain copyright and other rights you hold in your User Content.

5.2 License for Free Users

By using EggieAI on the free plan, you grant EggieAI a perpetual, worldwide, royalty-free, irrevocable, sublicensable, and transferable license to:

Host, store, reproduce, modify, adapt, translate, publish, publicly perform, publicly display, distribute, create derivative works from, and otherwise use your User Content for any purpose, commercial or otherwise, including:

• Operating and improving EggieAI
• Promoting EggieAI
• Developing and training AI systems
• Sublicensing content to third parties

This license continues even if you delete your account or content.

5.3 License for Paid/Monetized Users

By using EggieAI on a paid or monetized plan, you grant EggieAI a worldwide, royalty-free, sublicensable, and transferable license to:

host, store, reproduce, modify for formatting, publicly display, and distribute your User Content as necessary to operate and promote the Service, including publishing, sharing, and featuring content at our discretion (e.g., in feeds, showcases, marketing materials, and on official EggieAI channels).

EggieAI will not use paid users monetized works for internal AI training or direct commercial resale without additional consent.

Opt-Out & Removal Rights:

• If you do not want your published or featured content to appear in promotions, showcases, or official channels, you may notify us to opt out.
• You may also request removal of specific promoted works, and EggieAI will take them down within a reasonable time.

5.4 Content Removal

• Deleted content will be removed from public view
• We may retain backups and aggregated or anonymized data
• Content may continue to exist where it has been shared, sublicensed, or used in derivative works

6. AI-Generated Content

Content generated by our AI systems is based on your prompts and inputs. You acknowledge that:

• AI-generated content may not always be accurate, appropriate, or as expected
• Similar prompts from different users may produce similar outputs
• You are responsible for reviewing and approving all content before publishing or sharing
• AI outputs may be subject to limitations under intellectual property laws in some jurisdictions

7. Intellectual Property Rights

The Service, including its design, features, functionality, software, and all related intellectual property, is owned by EggieAI and is protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, distribute, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use the Service to build a competitive product or service
• Remove or alter any copyright, trademark, or proprietary notices
• Use automated tools to scrape or extract data from the Service

8. Payment and Subscriptions

Some features of the Service require payment. By purchasing a subscription or making a payment, you agree to:

• Provide accurate and complete payment information
• Pay all applicable fees as described at the time of purchase

• Understand that subscriptions automatically renew unless canceled

• Misuse EggieAI for spam, bots, or malicious activities

In addition to content restrictions, you may not:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use the Service to transmit spam or unsolicited messages
• Collect user information without consent
• Create multiple accounts to abuse free trial or promotional offers
• Share your account credentials with others
• Use the Service in a way that could damage our reputation

10. Third-Party Services

The Service may integrate with or contain links to third-party services, including:

• Authentication providers (Clerk, Google, Apple, Facebook)
• Payment processors (Stripe)

We are not responsible for third-party services. Your use of third-party services is subject to their terms and privacy policies.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EGGIEAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify, defend, and hold harmless EggieAI, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

14. Business Transfers

If EggieAI is acquired, merged, or sold, your data and User Content licenses may transfer to the new entity.

15. Termination

We may suspend or terminate your account and access to the Service at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Any other reason at our discretion

You may delete your account at any time by contacting support. Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will remain in effect.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where EggieAI is established, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property or confidentiality matters.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EggieAI regarding the Service and supersede any prior agreements.
